Jussie Smollett is appealing his conviction for staging a racist and homophobic attack on himself and lying to the Chicago police about it – almost one year after he was sentenced to five months in jail. Smollett, who used to be on the TV show “Empire,” is seeking a new trial because he claims “prosecutorial misconduct” was “clear and egregious.” He says that another trial is necessary as he had unfair treatment.
Smollett had claimed that in January 2019, on a freezing early morning, two men approached him and hurled slurs at him. They punched him before pouring a chemical substance on him and wrapping a noose around his neck. However, Chicago police said Smollett orchestrated the attack to boost his Hollywood career. He was found guilty of five counts of disorderly conduct, and jurors said he lied to the police.
He was sentenced to 150 days in jail, but you’ll never guess what! After spending only six days in jail—where he apparently only drank ice water—he was released. His lawyers say that his protection against double jeopardy was violated, and claimed that there was “prosecutorial misconduct.” They are arguing for a new trial, saying that he was not treated fairly.
Two weeks before FOX Nation is set to premiere its savvy docuseries, “Jussie Smollett: Anatomy of a Hoax,” he is arguing his case, and his attorneys are confident they have a chance. They claimed that there were “biased” decisions by the trial judge, and that there was “prosecutorial misconduct, including allegations that a defense witness was pressured to change his statement.”
