CNN’s senior legal analyst Elie Honig remarked during CNN’s “Newsroom” on Wednesday that the dismissal of multiple charges in former President Donald Trump’s Georgia election racketeering case by Fulton County Superior Court Judge Scott McAfee is a source of embarrassment for Fulton County District Attorney Fani Willis and her team.
According to Honig, “This ruling doesn’t alter the type of evidence the DA can present, but it does eliminate some charges. It’s embarrassing for prosecutors. When a charge gets thrown out before trial, it reflects a misstep by the prosecution.”
He continued, “There have been several missteps by the DA in this case’s history. From the investigative phase, the DA’s actions led to her disqualification due to a political conflict of interest. Fani Willis was removed from the case by the grand jury’s overseeing judge. There have been questionable public statements made by Willis that seem to breach prosecutorial ethics rules, and now six charges have been dismissed. Unlike the conflict of interest issue, this directly affects the charges against the defendant and the indictment itself.”
Honig concluded, “While there is still a case with the lead charge of racketeering intact, this is definitely a setback.”
