Biden Administration Warns of Legal Action Against Texas Over Implementation of Stringent Immigration Law

Abbott Unveils Comprehensive Border Measures, Grants Texas Officers Authority to Arrest Undocumented Immigrants

Earlier this month, Greg Abbott signed the measure into law.

On Thursday, the Biden administration issued a stern warning to Texas, indicating its intent to pursue legal action against the state if it proceeds with implementing a law that grants state officials the authority to apprehend immigrants crossing the border unlawfully.

The Justice Department has outlined its plan to initiate a lawsuit against the legislation, known as SB4, by January 3 unless Texas provides assurance that it will refrain from enforcing the measure. Brian Boynton, Principal Deputy Assistant Attorney General, urged Texas Governor Greg Abbott to avoid enforcing SB4, citing its unconstitutional nature and its potential disruption of federal government operations.

“Because SB 4 is unconstitutional and will disrupt the federal government’s operations, we request that Texas forbear in its enforcement,” stated Principal Deputy Assistant Attorney General Brian Boynton in a letter to Texas GOP Gov. Greg Abbott, as reported by CBS News.

Governor Abbott signed the law earlier in the month, with its slated enforcement set to commence in March 2024. Lawsuits against this law have already been filed by the American Civil Liberties Union (ACLU) and other advocacy groups.

According to Adriana Piñon, the legal director of the ACLU of Texas, the legislation undermines fundamental constitutional principles, violates federal immigration laws, and has adverse impacts on communities, especially those of Brown and Black residents.

“The bill overrides bedrock constitutional principles and flouts federal immigration law while harming Texans, in particular Brown and Black communities,” said Adriana Piñon, legal director of the ACLU of Texas.

In contrast, Brandon Judd, President of the National Border Patrol Council, commended Governor Greg Abbott’s efforts in enhancing border security. Judd expressed that Border Patrol agents across the nation appreciate Governor Abbott’s leadership, acknowledging the crucial importance of upholding the rule of law for the safety and security of all Americans.

“Border Patrol agents nationwide, not just in Texas, are grateful for Governor Abbott’s leadership and willingness to recognize that it is the rule of law that keeps all Americans safe,” remarked Judd.
