The Department of Education had previously sought to modify Title IX to include “gender identity” as a protected class. On Friday, the administration officially dropped the proposed regulation, marking a retreat from an aggressive push to enforce this controversial agenda.
The rule, introduced in April 2023, was titled “Nondiscrimination on the Basis of Sex in Education Programs or Activities Receiving Federal Financial Assistance: Sex-Related Eligibility Criteria for Male and Female Athletic Teams.” Its aim was to prevent states from banning participation in sports based on gender identity. Currently, 23 states have laws restricting biological males from competing in girls’ sports in public schools.
